March EPA Federal Registry Updates

Effective date; April 3, 2026;
Summary: A proposed rule from the EPA to approve revisions to the SIP (Arizona state implementation plan) for the 1971 and 2010 sulfur dioxide (SO2) national ambient air quality standards (NAAQS) for the Hayden SO2 non attainment area.;
Effective date: comments must be received on or before April 6, 2026;
Summary: A proposed rule from the EPA to postpone the compliance date for Facility Response Plan (FRP) requirements for onshore non transportation related facilities that could cause worst case harm to the environment from CWA hazardous substances. There will be a three year delay for this compliance date with possible sectors affected listed further in the article.;
Effective date: comments must be received on or before May 4, 2026;
Summary: A proposed rule from the EPA to establish a date for sunsetting use of paper manifests in favor of electronic manifests for the hazardous waste manifest regulations. This would result in $28.5 million annual savings for the switch from paper to electronic and have an increase in human health and environmental protection with improved public communication.;
Effective date: May 11, 2026;
Summary: A final rule from the EPA to finalizing new source performance standards (NSPS) and emission guidelines for the large municipal waste combustion (MWC) source category. Limits for cadmium, lead, particulate matter, polychlorinated dibenzodioxins and dibenzofurans, mercury, hydrogen chloride, and sulfur dioxide will be revised. This will result in 3,269 tpy reduction in regulated pollutants from previous existing sources through implementation of the final emission limits.;
Effective date: April 13, 2026;
Summary: A final rule from the EPA to add the site Gelman Sciences Inc to the General Superfund section of the NPL (National Priorities List). This helps the EPA to assess the site for further investigation and the nature of public health and environmental risks associated with the site.;
Effective date: May 1, 2026;
Summary: a proposed rule from the EPA to amend the Commercial Sterilization Facilities NESHAP that was published in 2024. This would alter the risk based standards, revise the standard for new aeration room vents from the technology review, revise the compliance demonstration requirements, and take back a requirement related to permanent total enclosure (PTE).;
Effective date: March 18, 2026;
Summary: A final rule from the EPA to finalize amendments to the National Emission Standards for Hazardous Air Pollutants (NESHAP) for the polyether polyols (PEPO) production source category. The ethylene oxide (EtO) specific standards for the Clean Air Act section 112 ;and maximum achievable control technology (MACT) standards for emission points, work practice standards for process vents and test reports will be finalized as well.;
Effective date: March 19, 2026;
Summary: Regulatory determinations from the EPA for nine contaminants that are listed on the fifth Contaminant Candidate List. They will not be regulating 2-aminotoluene, cylindrospermopsin, ethoprop, microcystins, molybdenum, permethrin, profenofos, tebuconazole, and tribufos.
Effective date: May 4th, 2026;
Summary: A proposed rule from the EPA for two separate actions under the Clean Air Act section 129. The first action is to consolidate existing provisions for large municipal waste combustors (LMWC), small municipal waste combustors (SMWC), commercials and industrial solid waste incinerators (CISWI), and other solid waste incinerators (OSWI). The second action involves subpart provisions for the CISWI units to combust debris from a qualifying disaster or emergency on a temporary basis without complying with CAA section 129 requirements.;
Effective date: March 23, 2026;
Summary: A final rule from the EPA to determine that the Phoenix-Mesa nonattainment area would have attained the 2015 ozone national ambient air quality standards (NAAQS) by August 3, 2024 which is the Moderate area attainment date. The state is no longer required to submit attainment and reasonable further progress (RFP) contingency measures for this area.;
Effective date: March 25, 2026;
Summary: A final rule from the EPA to establish a maximum permissible level for residues of methyl end-capped polydimethylsiloxane (dimethylpolysiloxane as an inert ingredient in a pesticide chemical formulation under 40 CFR 180.960) when found on food or feed commodities. This petition was submitted by Momentive Performance Materials Inc and is regulated by the Federal Food, Drug, and Cosmetic Act (FFDCA).;
Effective date: April 27, 2026;
Summary: A proposed rule from the EPA to extend certain compliance dates for the regulation of perchloroethylene (PCE) and carbon tetrachloride (CTC) under the Toxic Substances Control Act (TSCA). The compliance date for initial monitoring for inhalation exposure and existing chemical exposure limit (ECEL) will be extended to June 21, 2027. A respiratory PPE compliance date for non-federal entities is also being extended for PCE to create an exposure control plan by December 20, 2027.;
Effective date: April 29, 2026;
Summary: A proposed rule from the EPA to extend the reporting deadline for the Health and Safety Data Reporting Rule by one year to May 21, 2027. This is regulated under the Toxic Substance Control Act (TSCA) and will delay compliance during EPA’s ongoing reconsideration of the rule.;
