June EPA Federal Registry Updates

Effective date: june 3, 2026;
Summary: A final rule from the EPA to finalize the residual risk and technology review (RTR) that was conducted for the National Emission Standards for Hazardous Air Pollutants (NESHAP) from hazardous waste combustors (HWC). The EPA will be enforcing emissions standards for hydrogen fluoride (HF) and hydrogen cyanide (HCN) from these major source HWC incinerators, cement kilns, solid fuel boilers, and liquid fuel boilers.;

Ozone Reclassification State Implementation Plan Rule
Effective date: comments must be received on or before July 13, 2026;
Summary: a proposed rule from the EPA for reconsideration of the January 2025 final rule entitled State Implementation Plan Submittal Deadlines and Implementation Requirements for Reclassified Nonattainment Areas Under the Ozone National Ambient Air Quality Standards.;
Pesticide Tolerance; Exemptions, Petitions, Revocations, etc.: Pydiflumetofen
Effective date: June 15, 2026;
Summary: A final rule from the EPA to establish a maximum permissible level for residues of pydiflumetofen (CASRN 1228284-64-7) in or on the food and feed commodities of sugarcane, cane. This is regulated under the FFDCA and was submitted by Syngenta Crop Protection LLC.;
Sodium Nitrate in Pesticide Formulations
Effective date: June 15, 2026;
Summary: a final rule from the EPA to eliminate the need to establish maximum permissible level for residues of sodium nitrate (CAS Reg. No. 7631-99-4) when it is used as an inert ingredient (dilutant/oxidizer) in pesticidue formulations when used for raw agricultural commodities post harvest. This is regulated by the FFDCA and was submitted by AgroFresh Inc and also corrects a typograpbical error where a digit was previously omitted and did not represent a chemical properly.;
Effective date: june 18, 2026;
Summary: a final rule from the EPA to eliminate the need to establish maximum permissible level for residues of resin acids, esters with glycerol (CAS Reg. No. 8050-31-5) when it is used as an inert ingredient (surfactant) for growing crops and raw agricultural commodities pre and post harvest. This is regulated by the FFDCA and the exception was submitted by Croda Inc.;
Effective date: November 29, 2024;
Summary: a final rule from the EPA to amend the Code of Federal Regulations and removing provisions for the 2024 final rule, “National Emission Standards for Hazardous Air Pollutants: Rubber Tire Manufacturing” (“2024 Rubber Tire Rule”). This rule promulgated first-time air emissions standards for the rubber processing subcategory of the rubber tire manufacturing source category.;
Effective date: August 21, 2026;
Summary: A final rule from the EPA to improve first responder and community safety by conforming the Emergency Planning and Community Right-to-Know Act reporting regulations for OSHA’s standards. This will reduce discrepancies and confusion and prevent mis interpretation on facilities that use Material Safety Data Sheets for their annual hazardous chemical inventory reports.;
Effective date: July 23, 2026;
Summary: a proposed rule from the EPA for a revision to the Arizona State Implementation Plan that amends the Cleaner Burning Gasoline (CBG) program which focuses on reducing emissions of ozone-forming pollutants, carbon monoxide (CO), and particulate matter in the greater Phoenix metropolitan area. It also addresses the Winter Oxygenated Fuel program that controls CO emissions in the Tucson area. This will update the existing SIP approved CBG program and overall improve clarity and flexibility.;
