December EPA Federal Registry Updates

Effective date: December 3, 2025;

Summary: A rule from the EPA to take final action on an interim final rule (IFR) in regards to emissions guidelines (EG) for crude oil and natural gas facilities. Specifically, the rules outlined in 40 CFR part 60, subparts OOOOb and OOOOc with comments being reviewed that were published on July 31, 2025. These rules focus on provisions for control devices, equipment leaks, storage vessels, process controllers, and covers/closed vent systems.;


Effective date: comments must be received on or before Feb 2, 2026;

Summary: A notice from the EPA seeking comments on an Updated Draft Risk Calculation Memorandum for revised risk evaluation of formaldehyde under the Toxic Substances Control Act (TSCA).;


Effective Date: comments must be received on or before February 2, 2026;

Summary: A notice from the EPA seeking comments on a renewal of an existing ICR that is currently approved through July 31, 2026 before submission to the Office of Management and Budget (OMB). The ICR in discussion is titled PCBs, Consolidate Reproting and Recordkeeping Requirements (EPA ICR No. 1446.15 and OMB Control No. 2070-0112) which focuses on regulating the marking and disposal of PCBs, and the manufacturing, processing and distribution of PCBs as well. ;


National Emission Standards for Hazardous Air Pollutants for Coke Ovens: Pushing, Quenching, and Battery Stacks, and Coke Oven Batteries; Rescission of Extension of Compliance Deadlines for Coke Oven Facilities

Effective Date: December 5, 2025;

Summary: A rule from the EPA to repeal the IFR titled “National Emission Standards for Hazardous Air Pollutants for Coke Ovens: Pushing, Quenching, and Battery Stacks, and Coke Oven Batteries; Residual Risk and Technology Review, and Periodic Technology Review.” This IFR was originally published on July 8, 2025 and will comply with 2024 final rule National Emission Standards for Hazardous Air Pollutants (NESHAP). Concerns about industries being able to comply with both MACT standards for PQBS source category and leak limits for doors, lids, and offtakes since installation of additional controls may be unavailable or infeasible prompted this repeal.;


Effective date: January 12, 2026;

Summary: A final rule from the EPA to approve revisions about emissions of volatile organic compounds (VOC) from solvent cleaning activities and architectural coatings as well as emissions of particulate matter (PM) from incinerators, burn-off ovens and crematories. These revisions are intended for the Maricopa County Air Quality Department (MCAQD) portion of the Arizona State Implementation Plan (SIP) and are under the Clean Air Act (CAA).;

Summary: A final rule from the EPA to approve Arizona’s Nonattainment New Source Review (NNSR) of emissions from major stationary sources for purposes of the 1987 PM10 National Ambient Air Quality Standards (NAAQS).;


Effective date: comments must be received on or before February 9, 2026;

Summary: A proposed rule from the EPA to apply numerous tolerance actions under the Federal Food, Drug, and Cosmetic Act (FFDCA) for the following pesticides: 40 CFR 180. [220, 226, 318, 328, 339, 409, 411, 458, 572, 620].;


Effective date: comments must be received on or before February 9, 2026;

Summary: A notice from the EPA seeking comments for the ICR titled: “Revisions to the RCRA Definition of Solid Waste” (EPA ICR No. 2310.08, OMB Control No. 2050-0202).;


Effective date: December 16, 2025 with comment hearings open until February 17, 2026;

Summary: A final rule from the EPA about eliminating a maximum permissible level for residues of SpCas9 protein found in or on food and feed commodities of citrus when used as a plant-incorporated protectant (PIP). This request for exemption of a tolerance was submitted by Soil Culture Solutions LLC.;


Effective date: comments must be received on or before January 15, 2026;

Summary: A notice from the EPA seeking comments on initial filings of pesticide petitions and modification of regulations for these residues in or on various commodities. Summary: A final rule from the EPA to approve revisions for the implementation, maintenance and enforcement of the 2012 fine particulate matter (PM2.5) national ambient air quality standards (NAAQS) under the Clean Air Act (CAA). As well as amending regulatory text in order to include the La Paz County into the Mohave-Yuma Intrastate air quality control region (AQCR).;

Summary: A final rule from the EPA to create time-limited tolerances and maximum permissible levels for residues of flupyradifurone (metabolites and degradates included) found in or on sugarcane, cane, and sugarcane molasses.;
