2020 Pima & Maricopa County Environmental Regulations Updates

Maricopa County Air Quality Department: Maricopa County Air Pollution Control Regulations recently updated the following sections on November 18,2020. 

Rule 350 Storage and Transfer of Organic Liquids (non gasoline) at an organic liquid distribution (old) facility(https://www.maricopa.gov/DocumentCenter/View/9971/Rule-350-AQ-2017-009-Notice-of-Final-Rulemaking-PDF?bidId= )

Summary: Maricopa County has made 16 revisions to this rule. The detailed summary of revision changes and rulings is attached in the link above. In general, the revisions include annual leak inspection requirements, clarifications of pressure/vent valve settings, fill pipe heights, gap measurements for external floating roof stationary storage, removal of utilizing AP Emission factors to determine tank temperatures, revised “gas tight” to “vapor tight”, include procedures to ensure “vapor tight”, deletion of table 350-1, when determining “vapor tight” a calibrated OVA and a CGD are required, Optical Gas Imaging operator does not need to be certified but the machine must be calibrated prior to identifying a leak, added subsections to 506.1(h) and (i) to provide more relevant requirements to an OGI, Deletion of 302.1(c)(2), added and deleted sections to ensure roof openings that require to be covered are identified, added and deleted sections to ensure one or more of the identified inspections techniques are required to be used when performing monthly inspections, deleted 304.1 and added 305.1 to provide information on proper connection and disconnection to ensure vapor balance system, and a requirement for owners and operators to perform a complete inspection of internal roof primary seals, measurement of gap areas and maximum gap of tanks when emptied or at least every five years.

Summary: Maricopa County has made 14 revisions to this rule. The detailed summary of revision changes and rulings is attached in the link above. In general the changes include; Updating ASTM standards to EPA approved ASTM standards, moved vapor pressure measurement to section 501, repeat of clarification of pressure /vent valve setting requirements, deleted 303.4d and added 305.5, added section 402.3 to reference gap measurement requirements, removed AP 42 emissions to determine tank temperature, broaden definition from “gas tight” to “vapor tight”, deleted 501.1 and added 501.2 to clarify the how to determine “vapor tight”, clarifies definition of “vapor tight”, Optical Gas Imaging operator is not required to be certified but OGI must be calibrated prior to identifying a potential leak, added subsections to include the relevant requirements when utilizing an OGI, added section 303.2d and 303.3e to clarify the coverings of roof opening on external and internal floating roof storage tanks and deleted 303.1, requirement for owners and operators to perform a complete inspection of internal roof primary seals, measurement of gap areas and maximum gap of tanks when emptied or at least every five years.

Summary: Maricopa County has made 12 revisions to this rule. The detailed summary of revisions changes and rulings is attached in the link above. In general the changes include; clarification of the exemption is only for gasoline cargo tanks subject to the section in 103.1 and can only load at bulk gasoline plant exempted from vapor loss control by section 103.4 of Rule 351. Added the phrase “or unload to clarify the rule in Section 102 applies to both unloading and loading. In section 502.2(a)(10) and (b)(12) printed name, title and contact information of person conducting the testing is now required. Section 103 was corrected for cross reference errors. Section 504.2 and 505.2 the verbiage “vapor valve loss test” was added to clearly indicated the required subtest. Deletion of Section 203,

Summary: Maricopa County has made 14 revisions to this rule. Detailed rule changes are attached in link above. In general the changes include but limited to deleting exemption for loading of aviation gasoline at airports under Section 103.2, added Section 305.1 to place ownership of the gasoline cargo tank equipment with vapor recovery to ensure that vapor recovery system is operating properly and meet requirements. Defined the type of detectors in Section 218. Operators of OGI equipment are not required to be certified but the equipment is required to be calibrated prior to leak detection. Added subsections to include requirements of OGI usage. Section 504.1 references EPA approved CARB test methods. Added Section 305.1 to require discontinuous use if vapor leak is detected and that it is prohibited to utilize system with defects of a vapor recovery system. Section 305.2 places gauge pressure requirements on gasoline cargo tanks. Deleted Section 301.1 and added Section 303.1 and 303.6 to clarify the requirements of vapor recovery system components and that the systems themselves are required to be CARB certified. Maricopa County ASTM standards to be replaced by EPA approved ASTM Standards. Added clarification of CARB component requirements. Added definition of “spill containment receptacle”. Deleted redundancies, revised section headers and inspection titles and deleted the phrase “submethods” and added EPA methods to the list of Test Methods. 

Rule 360 New Source Performance Standard, Rule 370 Federal Hazardous Air Pollutants Program, Rule Appendix G Incorporated Materials (https://www.maricopa.gov/DocumentCenter/View/34400/Notice-of-Final-Rulemaking-IBR-Rules-PDF?bidId= )

Summary: Rule 360 includes revisions to 40 CFR Part 60 Subparts AAA, XXX and QQQQ

Rule 370, includes revisions to 40 CFR Part 63 to Subparts A, AAAA, GGGG, KKKK, SSSS, VVVV, WWWW, YYYY, KKKKK, LLLLL, NNNNN, and PPPPP

Appendix G, includes revisions to 40 CFR Part 53 (Ambient Air Monitoring Reference and Equivalent Methods) and to 40 CFR Part 58 (Ambient Air Quality Surveillance).

Summary:  Revised wording by exchanging “trip” to “travel”. Adding “school” into the definition of major employer. Removing Section 3, Section 4 , Section 5, Section 6, Section 9 , Section 10 , Appendix A and all EER credit calculation language. Revised subsection to distinguish between major employer within area A and outside area A. Adding 19 definitions, revising 16 definitions, and removing 40 definitions. · Revised Section 3 (Requirements) and added SPS-2018-005 (Travel Reduction Program – Enforcement) into Section 4 (Enforcement).”

Summary: The changes to this ordinance include the exchange for the use of the word “temporary” as residential and “extended” for “construction or agricultural”. The fees will not be rated anymore and will be a flat permit rate of Residential $30 and Construction/Agricultural of $100
